These Terms of Service ("Terms") govern your access to and use of filmbro.com (the "Site") and any digital products, subscriptions, or services purchased or downloaded through it.

By creating an account, making a purchase, downloading a Digital Product, or otherwise using the Site, you agree to these Terms.

The Site is operated by CreatorGalaxy BV, trading as Filmbro, a company registered in Belgium ("Filmbro," "we," "us," or "our").

Nothing in these Terms limits any rights you may have under mandatory consumer protection laws. If any provision of these Terms conflicts with rights that cannot legally be excluded or limited, those statutory rights will prevail.

1. Eligibility

You must be at least 18 years old, or otherwise have the legal capacity required in your country of residence, to create an account or make a purchase on Filmbro.

By using the Site, you confirm that you meet this requirement.

2. Accounts

To download Digital Products or manage a paid plan, you may need to create an account.

You are responsible for:

• Providing accurate and current account information
• Keeping your login details secure
• All activity that occurs through your account

If you believe your account has been accessed without your permission, contact us immediately at hello@filmbro.com.

We may suspend or restrict an account where we reasonably believe it has been compromised, used fraudulently, or used in violation of these Terms or our License Agreement.

3. Plans and pricing

Filmbro currently offers the following plans:

Free Plan

The Free Plan provides access to a selection of free Digital Products for personal, non commercial use, subject to any download limits or other restrictions described on the Site.

Annual Plan

The Annual Plan provides access to the full Filmbro library for personal and commercial use for a period of 12 months.

The Annual Plan is billed annually and automatically renews unless you cancel it before your next renewal date.

You may cancel your Annual Plan at any time. Cancellation prevents the next renewal charge, and your access will continue until the end of your current paid billing period.

Lifetime Plan

The Lifetime Plan is a one time purchase that provides access to the full Filmbro library for personal and commercial use, without recurring subscription fees.

For the purposes of these Terms, "Lifetime" means for as long as Filmbro continues to operate and provide the applicable service. It does not refer to the lifetime of the customer or guarantee that the Site or service will operate indefinitely.

Lifetime customers will continue to receive access to Digital Products added to the Filmbro library while the applicable service remains available, unless a product or service is clearly offered separately and stated not to be included in the Lifetime Plan.

Pricing

Prices are displayed in the currency shown at checkout. The total amount payable, including applicable taxes where required, will be shown before you complete your purchase.

We may change our prices from time to time.

Price changes will not affect purchases that have already been completed or the current prepaid billing period of an Annual Plan.

We may change the price applicable to future Annual Plan renewals. Where required, we will provide advance notice so that you have an opportunity to cancel before the new price takes effect.

4. Digital Products and licensing

All templates, LUTs, VFX assets, presets, project files, and other downloadable or digital assets available through Filmbro are referred to in these Terms as "Digital Products."

Digital Products are licensed, not sold, to you.

Your rights to download and use Digital Products are governed by our License Agreement and End User License Agreement, which form part of these Terms.

In summary:

• Free Plan downloads are for personal, non commercial use only
• Annual and Lifetime Plan downloads may also be used commercially, subject to the applicable license
• You may use Digital Products only within the rights granted by the applicable license
• You may never resell, redistribute, sublicense, share, or make raw Digital Products available to others except where expressly permitted by the applicable license

We may add, update, replace, reorganize, or remove individual Digital Products from the library over time, including for technical, licensing, legal, or quality reasons.

Access to a particular Digital Product is therefore not guaranteed indefinitely, even when you have an Annual or Lifetime Plan.

5. Payments, refunds and consumer rights

Payments

Payments for Annual and Lifetime Plans are processed through the payment providers made available at checkout.

By completing a purchase, you confirm that you are authorized to use the selected payment method and agree to pay the amount shown at checkout.

30 day money back guarantee

We offer a 30 day money back guarantee on eligible original purchases.

If you are not satisfied with your purchase, contact us at hello@filmbro.com within 30 days of your original purchase.

Our voluntary 30 day money back guarantee is separate from any statutory rights you may have under applicable consumer law.

The full conditions of the guarantee are available in our Refund Policy.

We reserve the right to refuse refund requests involving fraud, abuse, or misuse of the guarantee, to the extent permitted by applicable law and as further described in our Refund Policy.

Digital content and statutory withdrawal rights

Consumers in certain countries, including the European Union and European Economic Area, may have a statutory right to withdraw from certain online purchases.

For Digital Products supplied immediately after purchase, applicable law may allow this withdrawal right to end once delivery or performance begins, provided that you have expressly consented to immediate delivery and acknowledged that you will lose your withdrawal right once delivery begins.

Where required by law, we will ask you to provide this consent and acknowledgement before immediate access to the Digital Products is provided.

Nothing in this section affects rights that cannot legally be waived or limited.

6. Acceptable use

When using the Site, your account, or Digital Products, you agree not to:

• Violate any applicable law or regulation
• Infringe the intellectual property or other rights of Filmbro or any third party
• Attempt to gain unauthorized access to the Site, other accounts, servers, or systems
• Circumvent security measures, download limits, access restrictions, or other technical protections
• Use bots, scrapers, scripts, automated tools, or similar methods to access the Site or download Digital Products at scale without our permission
• Resell, redistribute, share, sublicense, or make Digital Products available outside the rights granted by the applicable License Agreement
• Upload or transmit viruses, malicious code, spam, or other harmful material
• Use the Site in a fraudulent or abusive manner

We may suspend, restrict, or terminate accounts that violate these Terms, our License Agreement, or applicable law.

Where reasonably possible and appropriate, we may provide notice before doing so. Serious abuse, fraud, security threats, or intellectual property violations may result in immediate suspension or termination.

Termination of an account does not give you the right to continue using Digital Products beyond the rights granted under the applicable License Agreement.

7. Intellectual property

All content available through the Site, including the Filmbro name, brand, logo, website design, graphics, text, software, Digital Products, and other materials, is owned by or licensed to CreatorGalaxy BV and is protected by applicable intellectual property laws.

Except for the limited usage rights expressly granted under our License Agreement or End User License Agreement, nothing in these Terms transfers ownership of any Filmbro intellectual property to you.

You may not copy, reproduce, distribute, modify, sell, license, or commercially exploit any part of the Site or Digital Products except as expressly permitted by us or by the applicable license.

8. Privacy and third party services

Our collection and processing of personal information is governed by our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation where applicable.

We use third party providers to operate parts of the Site and our services, which may include payment processors, ecommerce providers, hosting providers, email platforms, file delivery services, analytics providers, and security services.

Your use of certain third party services may also be subject to the terms and privacy policies of those providers.

The Site may also contain links to third party websites or services. We are not responsible for the content, availability, security, or practices of third party websites that we do not control.

9. Availability of the Site and Digital Products

We aim to keep the Site and Digital Products available and functioning correctly, but we cannot guarantee uninterrupted or error free access.

From time to time, the Site or certain services may be temporarily unavailable due to maintenance, technical problems, security issues, updates, events outside our reasonable control, or changes to third party services on which Filmbro relies.

We may modify, improve, replace, or discontinue features of the Site or service from time to time.

Nothing in this section limits any mandatory rights you have under applicable consumer law.

10. Disclaimers and limitation of liability

To the fullest extent permitted by applicable law, the Site, services, and Digital Products are provided "as is" and "as available."

We do not guarantee that:

• The Site will always be uninterrupted, secure, or error free
• Every Digital Product will work with every software version, operating system, device, plugin, or third party application unless we specifically state otherwise
• Every Digital Product will remain available indefinitely
• The use of a Digital Product will produce a particular creative, commercial, or financial result

You are responsible for checking any technical requirements listed for a Digital Product before using it.

To the fullest extent permitted by applicable law, Filmbro will not be liable for indirect, incidental, special, punitive, or consequential losses, including loss of profits, revenue, business opportunities, data, or savings arising from your use of the Site or Digital Products.

To the fullest extent permitted by applicable law, our total aggregate liability arising from a purchase, plan, or these Terms will not exceed the amount you paid to Filmbro for the purchase or plan giving rise to the claim.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, gross negligence, willful misconduct, death or personal injury where liability cannot legally be excluded, or any other liability that applicable law does not permit us to exclude or limit.

Nothing in this section affects mandatory consumer rights or statutory guarantees that apply to Digital Products or digital services.

11. Suspension and termination

You may stop using the Site at any time.

If you have an Annual Plan, you may cancel future renewals through the available account controls or by contacting us.

We may suspend or terminate access to an account where we reasonably believe that:

• These Terms have been materially violated
• Our License Agreement or End User License Agreement has been violated
• The account is being used fraudulently or unlawfully
• The account or its activity creates a security risk
• Digital Products are being redistributed, shared, scraped, or downloaded in an abusive or unauthorized manner

Termination or suspension does not affect any rights, obligations, or liabilities that arose before termination.

Any provisions which by their nature should continue after termination, including provisions relating to intellectual property, licensing, liability, and disputes, will continue to apply.

12. Changes to these Terms

We may update these Terms from time to time to reflect changes to our services, business, technology, or applicable law.

When changes are made, we will update the "Last updated" date at the top of this page.

Where required by law, we will provide additional notice of material changes.

Changes will not retroactively remove rights already granted to you for a completed purchase where doing so would be prohibited by law.

Material changes affecting existing consumer rights will apply only to the extent permitted by applicable law.

Your continued use of the Site after revised Terms take effect constitutes acceptance of those Terms where permitted by law.

13. Governing law and disputes

These Terms are governed by the laws of Belgium.

If you are a consumer, this choice of law does not deprive you of mandatory consumer protections that apply under the law of your country of residence.

For disputes that are not subject to mandatory consumer jurisdiction rules, the competent courts of Belgium will have jurisdiction.

If you are a consumer and applicable law gives you the right to bring proceedings in the courts of your country of residence, nothing in these Terms limits that right. Similarly, proceedings against a consumer will only be brought in another jurisdiction where permitted by applicable law.

If you have a complaint, please contact us first at hello@filmbro.com so that we can try to resolve the issue directly.

Consumers may also have access to an applicable alternative dispute resolution service. Consumers dealing with a Belgian company may, where applicable, submit a dispute to the Belgian Consumer Mediation Service.

14. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or, where necessary, removed.

The remaining provisions will continue in full force and effect.

15. Entire agreement

These Terms, together with our License Agreement, End User License Agreement, Refund Policy, Privacy Policy, and any other policies expressly incorporated by reference, form the agreement between you and Filmbro concerning your use of the Site, plans, services, and Digital Products.

They supersede any earlier versions of these Terms relating to the same subject matter, without affecting rights that already arose under a completed purchase.
